In New York the crime of causing a physical injury to a another person is called assault, which is commonly known as battery in other states. New York’s assault laws range from misdemeanor to felonies, depending on a person’s intent, the degree of any physical injury and if any weapons were involved. Assault in the Third Degree, a class A misdemeanor, is charged when a person intentionally or recklessly causes a physical injury to another person. Harassment in the Second Degree, which only requires physical contact and not an injury, is commonly charged with Assault in the Third Degree. Unlike Assault in the Third Degree, Harassment in the Second Degree is a violation and will seal unless the case involves domestic violence. In New York, Assault in the Third Degree is punished by up to 1 year in jail. But depending on the facts and circumstances of each case, a defense attorney may be able to negotiate a non-criminal disposition that may be sealed.
